{"id":1040,"date":"2023-01-08T16:04:06","date_gmt":"2023-01-08T16:04:06","guid":{"rendered":"https:\/\/crtax.us\/?p=1040"},"modified":"2026-03-16T19:57:09","modified_gmt":"2026-03-16T23:57:09","slug":"tudo-o-que-voce-precisa-saber-sobre-o-firpta-nos-eua","status":"publish","type":"post","link":"https:\/\/crtax.us\/es\/tudo-o-que-voce-precisa-saber-sobre-o-firpta-nos-eua\/","title":{"rendered":"todo lo que debe saber SOBRE FIRPTA EN EE.UU."},"content":{"rendered":"<p>\u00bfSabe qu\u00e9 informaci\u00f3n debe poseer cuando realiza una operaci\u00f3n de compraventa de bienes inmuebles en la que interviene una persona extranjera en Estados Unidos?<\/p>\n\n\n\n<p>Personas de todo el mundo invierten en bienes inmuebles en Estados Unidos, por lo que si va a comprar una propiedad a un propietario extranjero, aqu\u00ed tiene algunas cosas que debe saber. La Ley del Impuesto sobre Inversiones Extranjeras en Bienes Inmuebles de 1980, conocida como FIRPTA (Foreign Investment in Real Property Tax Act) puede ser aplicable a su compra. La FIRPTA es una ley fiscal que impone retenciones del impuesto sobre la renta a los extranjeros que venden bienes inmuebles aqu\u00ed, en Estados Unidos.<\/p>\n\n\n\n<p>A partir de la FIRPTA se plantean dos escenarios, el primero es cuando el vendedor solicita al IRS un Certificado de Reducci\u00f3n o Exenci\u00f3n del importe a retener, demostrando que tendr\u00e1 p\u00e9rdidas o que la plusval\u00eda ser\u00e1 mucho menor sin necesidad de retener el tipo impositivo de 10% o 15% seg\u00fan el caso. Una vez preparado este proceso el IRS emitir\u00e1 una decisi\u00f3n en un plazo de 90 d\u00edas, y si es Exento, el comprador simplemente no retendr\u00e1 la cantidad y pagar\u00e1 al vendedor en su totalidad, por otro lado si el IRS no aprueba, o aprueba una cantidad reducida, el comprador proceder\u00e1 como se explica a continuaci\u00f3n.<\/p>\n\n\n\n<p>En el segundo supuesto y seg\u00fan la normativa FIRPTA, la obligaci\u00f3n de retener hasta 15% del valor de la transacci\u00f3n recae sobre el comprador, as\u00ed por ejemplo si la transacci\u00f3n de compraventa del inmueble es de $500.000 el comprador al transferir ese recurso para pagar al vendedor debe retener $75,000 (15%) pagando s\u00f3lo el neto de $425.000 al vendedor y cobrando esa diferencia de $75.000 a Hacienda en el plazo de 20 d\u00edas desde la firma del contrato, o recibiendo la resoluci\u00f3n de Hacienda como se explica en el p\u00e1rrafo anterior, a trav\u00e9s del modelo 8288, expidiendo adem\u00e1s los modelos 8288-A y B al vendedor como justificante de la retenci\u00f3n.<\/p>\n\n\n\n<p>De hecho, es extremadamente importante conocer la normativa FIRPTA, porque si usted como comprador no retiene el impuesto o no sigue los procedimientos exigidos por la ley, Hacienda puede exigirle que pague usted mismo el importe del impuesto no retenido, adem\u00e1s de aplicarle multas e intereses.<\/p>\n\n\n\n<p>El valor de retenci\u00f3n puede variar en funci\u00f3n de los siguientes criterios:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>0% retenci\u00f3n para Inmuebles de menos de $300.000 (trescientos mil d\u00f3lares) adquiridos por un particular que tenga intenci\u00f3n de residir en el inmueble.<\/li><li>Retenci\u00f3n 10% para Propiedades superiores a $$300,000 (trescientos mil d\u00f3lares) y $$1,000,000 (un mill\u00f3n de d\u00f3lares) adquiridas por un individuo que tiene la intenci\u00f3n de residir en la propiedad.<\/li><li>15% retenci\u00f3n en todos los dem\u00e1s casos.<\/li><\/ul>\n\n\n\n<p>Por \u00faltimo, por parte del Vendedor, teniendo en cuenta que se ha efectuado la retenci\u00f3n y que el comprador ha cumplido con todos los requisitos de la normativa FIRPTA, el IRS enviar\u00e1 el Formulario 8288-A sellado a la direcci\u00f3n del Vendedor con instrucciones para que \u00e9ste presente una declaraci\u00f3n de la renta con el fin de calcular la plusval\u00eda y compensar el impuesto ya retenido. En la mayor\u00eda de los casos, si el vendedor no ha solicitado a Hacienda un certificado de reducci\u00f3n o exenci\u00f3n, tendr\u00e1 derecho a la devoluci\u00f3n total o parcial de la cantidad retenida, ya que en el momento de la declaraci\u00f3n podr\u00e1 deducirse tanto el coste de adquisici\u00f3n de su inmueble vendido como los gastos que tuvo con el cierre del contrato, comisiones, honorarios y otros.<\/p>\n\n\n\n<p>\u00bfNecesita ayuda para cumplir con sus obligaciones FIRPTA?
